"OSTP Directive and FASTR

Mandated public access to publications and data

In February 2013, the White House Office of Science and Technology Policy (OSTP) issued a Memorandum on Increasing Access to the Results of Federally Funded Scientific Research. The Memorandum, a.k.a. the OSTP Directive, directed federal agencies that fund more than $100 million in research to develop policies requiring public access and re‐use rights to peer‐reviewed publications and digital data arising from that funding. The Directive went into effect immediately. Draft policies must be available for review by September 2013. The effective dates of the policies can be no sooner than the publication date of the agency’s final plan. The Open Data Policy was issued in May 2013.

Pending legislation

Also in February 2013, the Fair Use of Science and Technology Research Act [pdf] (FASTR) was introduced in both the House and the Senate with bipartisan support. FASTR requires federal agencies that fund more than $100 million in research to develop policies mandating public (open) access and re-use rights to peer-reviewed publications arising from that funding. FASTR must be passed into law to take effect.

"...this Memorandum requires agencies to collect or create information in a way that supports downstream information processing and dissemination activities. This includes using machine readable and open formats, data standards, and common core and extensible metadata for all new ¬information creation and collection efforts. It also includes agencies ensuring information stewardship through the use of open licenses and review of information for privacy, confidentiality, security, or other restrictions to release. Additionally, it involves agencies building or modernizing information systems in a way that maximizes interoperability and information accessibility, maintains internal and external data asset inventories, enhances information safeguards, and clarifies information management responsibilities."

The National Institutes of Health (NIH) is seeking public comments on the draft Genomic Data Sharing (GDS) Policy that promotes sharing, for research purposes, of large-scale human and nonhuman genomic1data generated from NIH-supported and NIH-conducted research.

A Notice by the National Institutes of Health on 09/20/2013. To ensure that your comments will be considered, please submit your response to this Request for Comments no later than 60 days after publication of this notice.
Berkman Center for Internet & Society - Harvard Open Access Project (HOAP)
HOAP was launched in the fall of 2011 to foster OA within Harvard, foster OA beyond Harvard, undertake research and policy analysis on OA, and provide OA to timely and accurate information about OA itself.
